I don't think these packages should be marked as orphans before it's confirmed that new kernel works (e.g. new kernel is booted up and running). It doesn't mark running kernel as orphan so it should not mark its devel and modules as orphans either. What if user removes nvidia's module and new kernel won't boot? Nvidia is just an example, network modules are probably more serious problem.
